Telangana HC: Presumption u/s 139 NI Act is Unsustainable if Failure to Show Debt Transaction - 13.09.2021

Telangana High Court has observed that presumption under Section 139 of the Negotiable Instruments Act, 1881 is unsustainable if there is a failure to show the debt transaction in income tax return. The Court has remarked that the evidence placed on record by the complainant was not sufficient to prove the case against the accused beyond a reasonable doubt, thereby upholding the trial court's decision to acquit the accused.
