Delhi HC: When Provision Declared Unconstitutional, It Does Not Get Repealed or Wiped Out - 02.08.2021

Delhi High Court has held that when a provision is declared unconstitutional, it does not get repealed or wiped out; if the defects are cured through amendment, it will become enforceable. The Court has noted that if defects are cured the entire Section doesn't need to be re-enacted to be re-enforced.
