Chhattisgarh HC: Grant of Default Bail is Indefensible Right Under S. 167(2) CrPC - 12.07.2021

Chhattisgarh High Court has held that to arrive at a computation to calculate the delay in filing the charge sheet, the date of arrest is to be excluded and the date when charge-sheet was filed is to be included. The Court has also held that the grant of default bail is an indefensible right under Section 167(2) of the Code of Criminal Procedure, 1973 (CrPC), and the same cannot be defeated by filing a subsequent charge sheet.
