Madras HC: Petition Under Article 227 Maintainable for Both Civil and Criminal Proceedings - 14.06.2021

Madras High Court has held that a petition under Article 227 of the Constitution of India, 1949 is maintainable to seek the quashing of proceedings under the Protection of Women from Domestic Violence Act 2005 regardless of whether proceeding is civil or criminal in nature. The Court has observed that Article 227 is "forum-neutral", which makes no distinction between civil court and criminal court.
