CCI order against airlines’ cartelisation stayed

The Competition Appellate Tribunal stayed an order of the Competition Commission of India against various airlines for having cartelised in the freight market. Though the Tribunal did not specify reasons, it seemed amenable to Appellants’ arguments of violation of principles of natural justice, claiming having not been sent a show cause notice by the Commission. Other arguments on behalf of Interglobe Aviation Ltd. (Indigo) and Spicejet Limited sought to distance them from the cartel and questioned the quantum of fine imposed.
