Orissa HC Strikes Down Rule Allowing Senior Designation Without Proposal/ Application - 11.05.2021

Orissa High Court has struck down Rule 6(9) of the 'High Court of Orissa (Designation of Senior Advocate) Rules, 2019' which confers power on the Full Court to designate an Advocate as Senior in the absence of any proposal from Judges or application from such Advocate. The Court has observed that the Rule is not in consonance with the guidelines framed by the Supreme Court for conferment of senior designation in Indira Jaising v. Supreme Court of India.
