P&H HC Sets Aside Order Denying Children Custody to Mother Relying on Infidelity Allegations - 05.04.2021

Punjab and Haryana High Court has set aside a Trial Court's Order by which the custody of the children was denied to the Mother by relying on allegations of infidelity levelled against her. The Court observed that in view of Section 17 of the Guardian and Wards Act, 1890 as well as Section 13 of the Hindu Minority and Guardianship Act, 1956, the welfare of the minor is the paramount consideration to be kept in mind by the Court while appointing a guardian.
