Bombay HC: Epidemic Diseases Act Cannot Be Exercised to Transfer an Officer - 01.02.2021

Bombay High Court has denied relief to the Director of Medical Education and Research, TP Lahane, observing that Epidemic Diseases Act 1897 cannot be used to transfer a government employee. The Court has held that allowing the Director, to transfer a government servant disregarding the safeguards provided to him under the Regulation of Transfers and Prevention of Delay in Discharge of Official Duties Act, 2005 (Transfer Act), would make such a transfer arbitrary.
