Madras HC: Petition u/s 482 CrPC Not Maintainable to Quash Complaint u/s 12 DV Act - 19.01.2021

Madras High Court has held that a Petition under Section 482 of the Code of Criminal Procedure, 1973 (CrPC) to quash a complaint under Section 12 of the Domestic Violence Act, 2005 (DV Act) is not maintainable. The Court has observed that a petition under Article 227 of the Constitution of India, 1949 may be maintainable if it is shown that the proceedings before the Magistrate suffer from a patent lack of jurisdiction.
