Delhi HC: Default Bail Cannot Be Denied Just Because Application Filed u/s 439 CrPC - 11.11.2020

Delhi High Court has granted bail in a case where the accused was prepared to furnish bail and comply with the conditions under Section 167(2) of the Code of Criminal Procedure, 1973 (CrPC) but had submitted his application under Section 439 CrPC, stating that default bail cannot be denied merely on wrong filing of application.
