Calcutta HC: Section 29-A/31 of IBC Does Not Shield from Operation of Section 14 - 23.09.2020

Calcutta High Court has ruled that section 29-A or 31 of the Insolvency and Bankruptcy Code, 2016 would not provide a shield against the operation of its section 14(3)(b) and that the promoter-directors of the Resolution Applicant-Company, who are also guarantors of the Company, would not come under the immunity-blanket of Section 14.
