Madras HC: ‘Already Undergoing Sentence' to Mean Physical Detention Due to Execution of Sentence - 13.05.2020

Madras High Court has interpreted the word "already undergoing a sentence" under Section 427 of the Code of Criminal Procedure, 1973 as physical detention pursuant to execution of warrant of sentence, with an attempt to balance it with the fundamental right to personal liberty under Article 21 of the Constitution of India, 1949.
