Gujarat HC: Registration of FIR Does Not Implicate Person as Perilous to Maintenance of Public Order - 24.02.2020

Gujarat High Court has held that mere registration of First Information Report (FIR) against a person does not mean that he is a threat to the maintenance of public order. The Court further explained that unless and until the material is there to make out a case that the person has become a threat and menace to the Society, it cannot be said that the detenu is a person within the meaning of section 2(c) of the Gujarat Prevention of Anti Social Activities Act, 1985.
