CBI not investigating agency of court

The Delhi High Court allowed petitions against an order of the Special Court under the Prevention of Corruption Act, 1988 directing the Central Bureau of Investigation to investigate complaints. It reiterated that only the Supreme Court and the High Courts had jurisdiction to issue directions to CBI to investigate a matter, and the CBI was not the investigative agency of the court. The complaint, not pursued by the CBI for a lack of evidence, had been filed by a former General Secretary, RAW Employees Association, alleging that members of RAW had floated a private company in violation of the rules to embezzle funds. The complaint was founded on two articles published in newspapers in 1992.
