Supreme Court: Intoxication not Mitigating Factor when Accused is not in Highly Inebriated Condition - 16.12.2019

Supreme Court has observed that mere intoxication is not a mitigating factor when the Accused was not in a highly inebriated condition. The Court noted that the manner in which Accused poured the kerosene on the deceased and thereafter when she was trying to run away the Accused came from behind and threw a matchstick and set her ablaze, the death of the deceased will be said to be Culpable Homicide amounting to murder.
