Rajasthan High Court: Application for Anticipatory Bail by Juvenile Maintainable - 05.09.2019
Rajasthan High Court has ruled that an anticipatory bail application may be moved by a juvenile apprehending arrest. The Court observed that merely because Section 10 of the Juvenile Justice (Care and Protection of Children) Act, 2015 provides for apprehending a child in conflict with law and not for arresting him it cannot be held that an application under Section 438 of Code of Criminal Procedure, 1973 by him or her is not maintainable.
