Supreme Court Explains Civil Suit Objecting Jurisdiction of Arbitrator not Valid - 26.08.2019

Supreme Court has explained that a suit for injunction and declaration challenging the jurisdiction of arbitrator is not valid. The Court observed that any objection with respect to existence or validity of the arbitration agreement can be raised only by way of an application under Section 16 of the Arbitration and Conciliation Act, 1996 and Civil Court cannot have jurisdiction to go into such question.
