Allahabad HC: Prosecution for Offence of Waging War Will not Stand Without Govt Sanction - 14.08.2019

Allahabad High Court has ruled that prior Government sanction under Section 196 of Code of Criminal Procedure, 1973 is essential to take cognizance of offences like Section 121-123 of Indian Penal Code, 1860 and it thereby set aside the order of conviction and sentence of life imprisonment imposed on a Pakistani Jais-E-Mohommad Terrorist Group Member and another Indian citizen for want of such sanction.
