Kerala High Court: Complaint Under Section 138 NI Act Not Maintainable Against Trustees - 10.06.2019

Kerala High Court has noted that 'Trust' is neither a 'juristic person' nor an 'association of individuals' as per Section 141 Negotiable Instruments Act, 1881 (NI Act) while holding that no prosecution is possible against a trust and its trustees for dishonour of cheque invoking Section 141 of NI Act.
