NCLAT: No Bar to S. 138 Proceedings Under NI Act During Period of Moratorium Under IBC - 07.08.2018

National Company Law Appellate Tribunal, New Delhi has held that the court of competent jurisdiction may proceed with criminal proceeding under Section 138 of Negotiable Instrument Act even during the period of moratorium under Insolvency and Bankruptcy Code.
