NHAI to Charge Double Toll from Vehicles with Non-affixed FASTag on Front Windshield

To deter National Highway users from deliberately not fixing FASTag on the windscreen of the vehicle, NHAI has issued guidelines to collect double user fee from such users entering the toll lane with non-affixed FASTag on front windshield from the inside. Deliberate non-affixation of FASTag on the windscreen leads to unnecessary delays at the toll plazas causing inconvenience to the fellow National Highway users.

Detailed Standard Operating Procedures (SOP) has been issued to all User Fee Collection Agencies and Concessionaires to charge double user fee in case of non-affixation of FASTag on the front windshield. The information will also be prominently displayed at all User Fee plazas, informing highway users about the penalties for non-compliance of entering a toll lane without a fixed FASTag on front windshield.

In addition, CCTV footage with Vehicle Registration Number (VRN) at the fee plaza shall be recorded of the non-affixed FASTag cases. This will help in maintaining proper record regarding the fee charged and presence of the vehicle in the toll lane.

In accordance with already established rules, NHAI aims to enforce the standard procedural guidelines for affixation of FASTag on the front windshield of the assigned vehicle from inside. Any FASTag that is not affixed on the assigned vehicle as per standard process is not entitled to carry out Electronic Toll Collection (ETC) transaction at a User Fee Plaza and will have to pay double toll fee as well as can be duly blacklisted. Issuer banks have also been directed to ensure fixation of the FASTag to the assigned vehicle on front windshield at the time of issuance from various Point-of-Sale (POS).

NHAI collects user fee on National Highways as per the National Highway Fee (Determination of Rates and Collection) Rules, 2008. At present, user fee is collected for approximately 45,000 km of National Highways and Expressways at around 1,000 Toll Plazas on National Highways across the country.

With penetration rate of around 98 percent and over 8 crore users, FASTag has revolutionized the Electronic Toll Collection system in the country. This initiative of charging double user fee from non-affixation of FASTag will help to make toll operations more efficient and ensure seamless & comfortable journey for the National Highway users.

Central Government notifies replacement of old criminal laws with new

In pursuance of section 8 of the General Clauses Act, 1897 (10 of 1897), the Central Government hereby notifies that where any reference of the Indian Penal Code (45 of 1860), or the Code of Criminal Procedure, 1973 (2 of 1974) or the Indian Evidence Act, 1872 (1 of 1872 or any provisions thereof is made in any--

(a) Act made by Parliament; or

(b) Act made by the Legislature of any State;

(c) Ordinance;

(d) Regulations made under article 240 of the Constitution;

(e) President's order;

(f) rules, regulations, order or notification made under any Act, Ordinance or Regulation,

For the time being in force, such reference shall respectively be read as the reference of the Bharatiya Nyaya Sanhita, 2023 (45 of 2023) (BNS), the Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023) (BNSS) or the Bharatiya Sakshya Adhiniyam, 2023 (47 of 2023) (BSA), and the corresponding provisions of such law shall be construed accordingly.

For the time being in force, such reference shall respectively be read as the reference of the Bharatiya Nyaya Sanhita, 2023 (45 of 2023) (BNS), the Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023) (BNSS) or the Bharatiya Sakshya Adhiniyam, 2023 (47 of 2023) (BSA), and the corresponding provisions of such law shall be construed accordingly.

Department of Consumer Affairs, Government of India proposes amendment in Legal Metrology (Packaged Commodities) Rules, 2011

Keeping in view of the growing ambit of the market including both offline and online platforms, the Department of Consumer Affairs, Government of India is considering for an amendment in the Legal Metrology (Packaged Commodities) Rules, 2011 to establish uniformity for packaged commodities. The revised provision will provide that these Rules shall apply to all packaged commodities sold in bags in retail, except to the packaged commodities meant for the industrial consumers or institutional consumers.

This revised provision will help in establishing uniform standards/ requirements for packaged commodities, promoting consistency and fairness across different brands and products and will help consumers in making informed choices based on complete information.

The Department invites comments from stakeholders within 15 days, up to July 29, 2024.

The Legal Metrology (Packaged Commodities) Rules, 2011 requires for declaration of mandatory information like name and address of the manufacturer/ packer/ importer, country of origin, common or generic name of the commodity, net quantity, month and year of manufacture, MRP, Unit Sale Price, best before/ use by date in case of commodity become unfit for human consumption, consumer care details etc. on all pre-packaged commodities in the interest of consumers.

The Rules are applicable on all pre-packaged commodities except the following:

(a) packages of commodities containing quantity of more than 25 kilogram or 25 litre;

(b) cement, fertilizer and agricultural farm produce sold in bags above 50 kilogram; and

(c) packaged commodities meant for industrial consumers or institutional consumers.

The Rules are not applicable for the packaged commodities containing quantity of more than 25 kilogram or 25 litre except cement, fertilizer and agricultural farm produce sold in bags above 50 kilogram, because it is presumed that the packaged commodities meant for retail sale are not more than 25 kg. However, it is observed that the packaged commodities above 25 kg are also available in the market for retail sale, which is not as per the intention to make all declarations on pre-packaged commodities meant for retail sale.

Central Government exempts specified goods from the whole of goods and service tax compensation cess leviable under Customs Tariff Act

In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962) read with sub-section (12) of section 3, of Customs Tariff Act, 1975 (51 of 1975), the Central Government, on the recommendations of the Council, on being satisfied that it is necessary in the public interest so to do, hereby exempts all goods imported by a unit or a developer in the Special Economic Zone for authorised operations, from the whole of goods and service tax compensation cess leviable thereon under sub-section (9) of section 3, of Customs Tariff Act, 1975 (51 of 1975) read with sub-section (2) of section 8 of the Goods and Services Tax (Compensation to States) Act, 2017 (15 of 2017).

2. This notification shall come into force from the 15th July, 2024.

Central Electricity Regulatory Commission (Connectivity and General Network Access to the inter-State Transmission System) (Second Amendment) Regulations, 2024 to be effective from 15.07.2024

Whereas, the Central Electricity Regulatory Commission (Connectivity and General Network Access to the inter-State Transmission System) (Second Amendment) Regulations, 2024 (hereinafter 'Second Amendment Regulations') was published in the Gazette of India Extraordinary (Part-III, Section-4, No. 469) on 1.07.2024;

Whereas, Regulation 1.2 of the Second Amendment Regulations provides that these regulations shall come into force from such date as notified by the Commission;

And now, therefore, it is notified that the Second Amendment Regulations shall come into force with effect from 15.07.2024.

Central Electricity Regulatory Commission (Connectivity and General Network Access to the inter-State Transmission System) (Second Amendment) Regulations, 2024 to be effective from 15.07.2024.
